The French Chamber of Commerce in Singapore was pleased to host a session on “Drafting Arbitration Agreements: Practical Dos & Don’ts for In-House Counsel”, bringing together legal professionals for a focused and practical discussion on dispute resolution strategy.

The session provided concrete guidance for in-house counsel navigating arbitration clauses and institutional frameworks across Asia. 

Please find below key learnings: 

  • When drafting an arbitration agreement, keep it simple and use the model arbitration clauses of leading arbitral institutions as a starting point (eg ICC, HKIAC, SIAC);
  • The most important element in the arbitration agreement is the seat of arbitration. Leading seats in Asia are Singapore and Hong Kong; do not go off the beaten path;
  • Leading arbitration institutions have introduced shorter and more cost-effective procedures depending on the amount in dispute (eg, under the 2025 SIAC Rules, the streamlined procedure for disputes below SGD 1 million and the expedited procedure for disputes above SGD 1 million and below SGD 10 million).
