Crypto assets are no longer a niche concern for in-house teams – they sit squarely at the intersection of financial crime risk, regulatory compliance, and cross-border disputes. As digital assets become more embedded in commercial activity, legal teams must grapple with evolving AML, anti-corruption, and compliance expectations, alongside novel dispute scenarios arising from crypto-related transactions. Digital assets can be a payment mechanism, but blockchain can be record keeper – is crypto technology a friend or foe to compliance? We will discuss.
This practical session will explore how in-house counsels can identify, manage and mitigate crypto-related risks. Through real-world scenarios, participants will examine AML and compliance challenges unique to crypto assets, including regulatory exposure, internal controls, and investigation readiness. The discussion will also consider common and novel mitigation strategies. Finally we will also consider how crypto disputes are increasingly surfacing in arbitration, informed for instance by recent Singapore case law addressing digital assets and their valuation.
The session is designed to be interactive and experience-driven, encouraging participants to share perspectives and lessons learned. Our speakers – Rob Palmer, Partner in the Hogan Lovells International Arbitration team, and Khushaal Ved, Partner in the Investigations, White Collar and Fraud team – will provide practical insights from both the compliance and disputes angles, grounding the discussion in legal developments and focusing on actionable takeaways for in-house counsels.
