During negotiations, clauses pertaining to governing law and dispute resolution are often addressed towards the end. Parties involved in these negotiations commonly default to selecting their own law and jurisdiction, which may not always be the optimal solution. 

In this discussion, moderated by Olivier Monange, Partner at DS Avocats,you will explore:

- the various alternatives available for choosing the governing law, such as opting for the law of one of the involved parties

- selecting the law of a third jurisdiction, or even considering soft law principles

- delve into the decision-making process for resolving disputes, whether through traditional courts and if so, which jurisdiction's courts, or through alternative dispute resolution (ADR) mechanisms.
